Rahul Gandhi, the leader of the Congress, will appeal his judgement in a criminal defamation case on Monday before a court in Surat, Gujarat. According to sources on Sunday, Gandhi is likely to be present in the sessions court when the plea is entered contesting the lower court's decision condemning him to two years in prison. Rahul Gandhi would still be present as a plea opposing the lower court ruling is filed in the Surat sessions court on Monday, a member of his legal team said while asking anonymity.
He will travel to Surat with senior state and national officials of the Congress, according to reports. In a 2019 criminal defamation lawsuit brought against him for his "Modi surname" statements, Gandhi was found guilty and given a two-year prison sentence by the court of Chief Judicial Magistrate HH Varma in this city on March 23.
According to sections 499 and 500 of the Indian Criminal Code (IPC), it has found Rahul Gandhi, 52, guilty. He was also given bail by the court, and the punishment was postponed for 30 days so he could file an appeal with a higher court. Gandhi was expelled from the Lok Sabha on March 24 as a result of the Surat court's decision to find him guilty of criminal defamation.
The 168-page Surat court judgement against Gandhi, according to sources, has been translated by experts, and the petition is ready for filing; however, Gandhi's legal team is taking a "abundantly cautious approach" in light of the potential effects on the two other cases like it that were filed in Patna and Ranchi courts on the same grounds.
The sources added that Gandhi's legal team has 30 days (starting March 23) to appeal the case to the sessions court.However, party insiders said they were ready to move on, stressing that Gandhi is ineligible since he has criticised Prime Minister Narendra Modi "consistently and directly" ever since the 2016 demonetisation, which was followed by the GST law.
According to party insiders, Gandhi's disqualification has contributed to greater oppositional unanimity. As a result, 19 opposition parties now oppose the BJP with uncommon cohesion, up from only a few before.In the upcoming three to four weeks, the Congress is anticipated to host a significant gathering of senior leaders of these opposition groups.
Additionally, they believe that because of the Bharat Jodo Yatra's success, the BJP is attempting to dramatically and tellingly humiliate Gandhi.
